These terms govern your use of the My Finergy Android app, the web app at web.myfinergy.com and the website www.myfinergy.com (the "Services"), provided by Finergy Growth Solutions Pvt. Ltd., 504/505 Gera Imperium 1, Patto, Panjim, Goa, India ("Finergy", "we"). By creating an account or using the Services you agree to these terms and to our Privacy Policy.

1. Who can use the Services

The Services are for financial advisors, insurance agents and similar professionals aged 18 or over. You confirm that the information you give us is accurate and that you will keep it up to date.

2. Your account

You are responsible for your login details and for all activity under your account. Tell us promptly at sachin.finergy@gmail.com if you suspect unauthorised use. We may suspend or close accounts that breach these terms or the law.

3. What the Services do, and what they do not

Finergy provides software tools such as calculators, lead-generation material, client management and a professional profile. The Services are tools only. They do not provide investment, insurance, tax or legal advice, and calculator outputs are illustrations based on the inputs and assumptions you choose, not guarantees of returns. You remain solely responsible for the advice you give your clients and for holding any registration or licence your profession requires (for example with SEBI, AMFI or IRDAI).

4. Your content and client data

You keep ownership of the content and client data you add. You give us permission to store, process and display it only to run the Services for you. You confirm that you have the right and any required consent to enter your clients' information, and that you will use it lawfully.

5. Acceptable use

You agree not to:

  • Break the law or any regulator's rules, or mislead clients or the public.
  • Upload harmful, unlawful or infringing content, or malware.
  • Attempt to access other users' data, probe or disrupt the Services, or reverse engineer them.
  • Copy, resell or sublicense the Services without our written permission.
  • Use the Services to send spam or unsolicited messages.

6. Plans, payments and refunds

Certain features of My Finergy require a paid subscription. Plan pricing, billing periods, applicable taxes (including GST), and included features are displayed at the time of purchase. Payments are securely processed through Razorpay.

All subscription payments are non-refundable once the plan is activated. Users may cancel future renewals, but no refunds will be issued for the remaining subscription period.

We reserve the right to revise subscription prices with prior notice. Any changes will apply from the next billing cycle.

7. Our intellectual property

The Services, including the software, design, logos, text and the Finergy name, belong to Finergy or its licensors and are protected by law. We give you a limited, non-exclusive, non-transferable right to use the Services for your professional work while these terms apply.

8. Availability and changes

We work to keep the Services running but do not promise they will always be uninterrupted or error-free. We may change, add or remove features, with notice where reasonable.

9. Disclaimer and limit of liability

The Services are provided "as is" and "as available". To the extent the law allows, Finergy is not liable for indirect or consequential loss, lost profits or lost business, or for decisions you or your clients make using the Services. Our total liability for any claim is limited to the amount you paid us in the 12 months before the claim. Nothing here limits liability that cannot be limited by law.

10. Ending your use

You may stop using the Services and request deletion of your account at any time, as described in the Privacy Policy. We may suspend or end access if you breach these terms. Sections that should continue after that, such as ownership, liability and governing law, will continue.

11. Changes to these terms

We may update these terms. The new version will be posted here with a new "Last updated" date. Continuing to use the Services after a change means you accept it.

12. Governing law

These terms are governed by the laws of India. The courts at Panjim, Goa have exclusive jurisdiction over any dispute.
